AITA for refusing to give up my service dog and not punishing him after he growls because they try to take him anyway?

2020.09.25 03:36 rowdy_fish AITA for refusing to give up my service dog and not punishing him after he growls because they try to take him anyway?

Tl;dr mother and son think they have more right to my self trained service dog than I do because he is in a wheelchair. I refused this eventhough I have the time and resources to train another one. They then try to take him by pulling his tail. My dog starts growling at this and I refused to instantly pull him back or to punish him for it. I did pull him back one I regained my posture. Edit: in English he is an emotional support dog. Not a service dog. I apologise, I did not know the nuanced word in English.
So, for context, four years ago I was badly injured which left my spine in no better condition than cooked spaghetti. I have multiple denervations a year for this. (intentional surgical interruption of a nerve.)
Last year the most beautiful and kind dog chose us to live with. We call him Dopey and love him very much.
Eversince he was a puppy I've been training him really intensely in assisting me. Dopey is an American Stafford so not ideal for this but he is a smart boi and figures things out rather quickly. He picks things up, he gets stuff for me, pushes buttons, you get the drift. He also motivates me in getting my steps in for the day, even on the bad days.
Then to the asshole part. I was walking Dopey along the pond today and, as always, I take a little break by the water. I had just given Dopey a command to pick something up for me when a little kid in a wheelchair and his mum came up to us. He asked to pet him which I kindly refused since Dopey was working at that moment and can't be pulled out of focus.
The mother then goes whining about why I take him out in public when he's not to be petted. So I explained that he is working as my service dog and cannot be disturbed as he is still in training and gets too excited to focus.
Now all hell breaks loose. I should not have a service dog since I am obviously not disabled and her son has been on the waiting list for sooo long and that meant I was to give them Dopey. And even if I was disabled, his was worse so he deserved him more.
I started yelling at her (as she was at me) that she couldn't have him or even buy him for all the ****** money in the world and if the boy needed it so badly she could just train one herself like I did. I am def not proud of cursing in front of, what I think was, a six year old. But then the little brat started pulling on my dogs tail telling him to come, he belongs to him now. Dopey lost it, started growling at the kid and getting close. The kid is now laying on the ground, next to his wheelchair, crying.
Here's where I might be the asshole.
I refused to pull him back instantly (I know that dog will not attack unless told to) and absolutely refuse to punish Dopey for his reaction as this is how he is supposed to react to harrassment imo. A lot of my close friends and family however have told me I am wrong and should've punished him for his behaviour.
Some even suggested that since I work from home (awesome employer) I can easily train another one whilst she is probably a working mum who does not have the time. But he is my baby. I raised and trained him. Even if he didn't help me out, I love him too much to ever give him up.
So reddit, AITA?
First time poster so loads of clarifying edits because details are very important here apparently
Edit1: spelling and an unfinished sentence.
Edit 2: Dopey is not registred as a service dog. He is not official in my country. I trained him to help me out. He does not have a vest. I do not have an org. I raise him as a normal dog. English is not my first language, I might've messed up in my wording. I also do not call him that ever in my own language as it is not appropriate since he just simply isn't one. My apologies for giving the wrong idea, I didn't know how to word it appropriatly in English. From the comments I gather it is called an emotional support dog. Sorry 'bout that!
Edit 3: Let me clarify that Dopey is great with kids. Even annoying little brats. My niece has pulled his tail before and he did jack squat. Just looked at her once and got out. This kid janked his tail so hard he actually cried out in pain first, then turned around and growled. He didn't bark or jump. Just turned around and growled once. Let me also add since I kind of stopped the story there that the moment I regained my cool, (abt 10 seconds) I got my stuff and us both the hell out of there.
I also could not prevent the kid pulling in any way as I did not see it coming from him and pull back on his leash would've hurt him even more. I was shocked and speechless but again, regained posture and got us out of there as quickly as possible. For al those saying I did nothing.
Edit 4: I do not think Amstaff are an agressive breed. I however do believe that ANY dog that has received little to no training would bite. This is not my first dog, nor my first Amstaff. I'm well aware they are very kind, social and tolerable dogs.
Edit 5: Yes I am sure of the attacking as he was trained by an actual professional on this topic. When I say he gets too enthousiastic to focus, I mean he just loves to play and we haven't really practised on switching that on and off.

2020.09.23 16:13 kittehgoesmeow What A Day: Stark, Naked Ballots by Sarah Lazarus & Crooked Media (09/22/20)

"The president in the next week or so will be laying out his vision for health care... in the coming, I would say, two weeks." - Kayleigh McEnany and the Very Real, Not Made Up Health Care Plan

The Young And The Reckless

The official U.S.coronavirus death toll has soared past 200,000, President Trump continues to aggressively not give a shit, and in an enigma that historians will puzzle over for centuries to come, this is still shaping up to be a close election.
It is decidedly Not Great that thanks to decisions like these, the national caseload is once again growing as we head into the colder months.
Each dizzying coronavirus milestone is a reminder of the new normal we’ve been asked to accept, and of the collective mourning we’ve been denied—because the crisis isn’t over, because the president is a psychopath, because it would require a national reckoning. We can be sad about that, or we can channel that sadness into rage, and then action. 41 days.

Look No Further Than The Crooked Media

Happy National Voter Registration Day! If you read this newsletter, we assume you're already registered to vote. But now’s a great time to double check that you’re still registered at https://votesaveamerica.com/verify. This is especially important if you’ve moved since the last election, changed your name, live in a suppress-y state, or if you haven’t voted in a while. It's fast, it's easy, do it right now.
Once you’ve checked yourself, make sure your friends and family have verified their registration as well. Then head to https://votesaveamerica.com/everylast vote for volunteer opportunities to get new voters registered, and to donate to Register2Vote!

Under The Radar

The Pennsylvania Supreme Court’s ruling on “naked ballots” could land us in a huge post-election mess. Philadelphia’s top election official has warned that the court’s recent ruling, which invalidates ballots submitted without first being placed in secrecy envelopes, could spoil over 100,000 votes across the state. Donald Trump won Pennsylvania by all of 40,000 votes in 2016, so this is what we in the voting biz would call “clusterfuck conditions,” which could lead to a messy post-election legal battle reminiscent of the one in Florida in 2000. Pennsylvania’s GOP-controlled legislature isn’t likely to remedy this (because Republicans think spoiling your ballot is good for them) so our best bet is voter education: If you have family and friends in Pennsylvania, make sure they know to use the secrecy envelope. If you haven’t yet adopted a state, it’s a great day to commit to help save Pennsylvania.

What Else?

Sen. Mitt “Black Lives Matter” Romney (R-UT) wants the Senate to vote on President Trump’s yet-to-be-announced Supreme Court nominee, which means Mitch McConnell has locked up the votes he needs to confirm * someone * even though nobody knows who Trump will actually pick—almost as if Republicans only really care about ruling without the consent of the governed in perpetuity. (It looks increasingly likely that he’ll pick Amy Coney Barrett, though.)
Joe Biden refused to answer whether he would be open to expanding the Supreme Court if Republicans jam through a nomination, for a solid enough reason: “Let me tell you why I’m not going to answer that question. Because it will shift the focus, that’s what he wants, he never wants to talk about the issue at hand and he always tries to change the subject.”
The FDA is set to announce tougher standards for emergency authorization of a coronavirus vaccine that would make it all but impossible for the administration to approve a vaccine before the election, so long as the Trump administration doesn’t override the FDA entirely, which would kinda give the game away.
A top-secret CIA assessment concluded that Vladimir Putin and his top aides are “probably directing” a disinformation campaign meant to help Trump win the election. Anyway, here’s Trump holding up his end of the bargain with a persuasive “uhhhh” when asked who he thinks poisoned Alexei Navalny.
The mayor of Louisville, KY, has declared a state of emergency ahead of a grand jury’s decision in Breonna Taylor’s case, and the city’s police have canceled all days off.
The University of California system wrongly admitted at least 64 wealthy students over the last six years, which is still not as bad as Harvard University admitting one Jared Kushner in 384 years.
Here it is, the most 2020 company that ever 2020’d: the gig economy, but for evictions.
Mel Gibson, who still has a career for some reason, is reportedly making a sequel to The Passion of the Christ. Passion of the Christ II: Oops, All Antisemitism!
Had a tough day? Need to unwind? Pour yourself a glass of merlot and let John Boehner’s book cover tell you about the time it met Frank Sinatra down at the racetrack.

Be Smarter

Senior congressional staffers believe that voters are much more conservative than they actually are. Researchers sent a survey to the chiefs of staff and legislative directors of every House and Senate office, who are largely responsible for setting lawmakers’ legislative agendas. The survey asked staffers to estimate public support in their own districts or states for five policy proposals, and the results found them to be way off base: Staffers from both parties significantly underestimated public support for progressive proposals. Lobbyists, to everyone’s shock and surprise, seem to be the main source of the problem: Offices that reported more reliance on special interest groups for policy-making, or received more money from corporate interests, had a much worse understanding of their constituencies. Let this be a reminder to keep on calling your reps, who will otherwise continue picturing you as Ronald Reagan with a gun.

Mike Bloomberg has raised more than $6 million to pay the court fines and fees of nearly 32,000 Black and Hispanic Florida voters with felony convictions. (Seems like he could’ve just written a check, but listen, we’ll take it.)
North Carolina election officials have agreed to extend the deadline for absentee ballots and set up ballot drop-off stations. (Seems like that shouldn’t have required a lawsuit, but listen, we’ll take it.)
A whopping 750,000 (presumably young) people have now registered to vote through Snapchat.
The first large scale coronavirus-sniffing dog trial is upon us.

Enjoy

2020.09.21 14:50 Draemeth [For Hire] Marketing and SEO

My name is Zack Frederick and I started doing marketing several years ago as i began my first yoga ‘e-business', realising very quickly that the difference between me and the next John Doe wasn’t the product but the presentation. So I set about, by trial and error, learning how I could sell more Yoga mats than John Doe. It wasn’t long before I realised I was very good at the marketing aspect, and I didn’t really like things like warehousing and distribution.
Today I’m most interested in building reports, designing paid campaigns and helping with Instagram.
I’ve compiled a few free tips for general marketing and SEO.

Brand awareness

First off. Influencers will not magically make your website successful. You have to be your own influencer. Over my tenor, I have spent thousands on social media analysis, rebranding and learning tricks like sticking state names across American products or even changing the colour of my website depending on the demographics of my audience. Spoilers, guys love red. Here’s an example data set. https://imgur.com/gallery/7OHIx
Last year, I ran a campaign for one of my shoe clients, and we used the pride of state consumers to grow his shoe business. I researched the best colours to use for different states and gave him a list, we put the state names across his shoes and marketed directly to them through instagram. It wasn’t long before his conversion metrics were soaring.
Here's an example report from one of my clients - https://prnt.sc/iisqv8

Value

I have worked with a lot of musicians, a big part of them started with low view, audio-only videos. I learnt quickly that for them to achieve success they had to provide value, so i told them to create videos. They did and then ta-da, they had 4500 views when they only had 200 view music videos before. For the next step, I even got them contacts with massive digital celebrities. My proudest connection having been ‘Ninja’ during the height of his fortnite campaign, I organised the marketing behind several viral Fortnite music parodies with now millions of views.

Trend riding

Make use of trends in your business. If something is so mainstream and big, why ignore it? In the past I have made use of the political trends in the American election with trump AND hillary brands on some of my clients products, with the pro trump and pro hillary supporters wanting to sport their political beliefs no matter the cost.
I see a lot of website based businesses underuse social media with broad attempts at Facebook ads and Instagram ads, ill go to digital marketing agencies and see they either have no social following or a huge botted one. It's a terrible idea to buy followers, if you want to cut corners then you should look at buying a smaller business with a bigger social following.
Here’s the impressions from a tweet I made on the first day of creating a company a twitter platform and using trend riding and collaboration to grow it https://prnt.sc/huziu6 4K Impressions on one tweet in 15 minutes - we hit 80k impressions in the first day. I did this from simply mimiking the formula for success from a similiar company account, i don't want to try change the magic formula for success.

Direction

Adapt

You really do have to stay in touch with your business to know what's working and what isn't, companies like Toys R Us refused to do that and stuck with huge stockpiles of star wars toys and then they collapsed. Blockbusters where ahead of the curve for digital movies and then they refused to change, Netflix changed and Netflix won. Amazon learnt to use online selling and left companies like Tescos with financial crisis.
The big boom in marketing that I’ve seen is social media marketing, marketers can create huge social following for companies and use that platform to sell content for extremely low costs in comparison to the tens of thousands it costs to use other platforms such as radio. Social media marketing has become somewhat controversial, but it is important to always stay open minded.

Collaboration** & Viral content

I can not stress the importance of working with other people. Every billionaire i know of has had a mentor, every big company success story had business partners. I've had far more success in clients who have listened to me and done collaborative work with digital celebs, with a dog product business making thousands of sales when they worked with vlogger Zoella and gave her free products.
Viral content is very important because every Youtuber with over 1 million subscribers has started off big and managed to keep it big, nobody grinded and slowly rose up at an equal exponent. Hard work is fine but being consistent and mixing it up, copying the viral content of others is an easy way of bringing in secondary viewership and traffic. Pewdiepie, the biggest youtuber on the planet, started with viral horror content. Ninja, the biggest streamer, grinded for 7 years but only truly struck gold with the virality of Fortnite. So it makes sense to repeat their methods.

Key words

It is an obvious thing to say but it's neglected, key words are very important. I had a crypto business come to me and ask why their site wasnt doing very well, and i looked through it and saw they never mentioned anything beyond bitcoin. Bitcoin is a very expensive key word to market, with costs of the raw word being as high as 38$ per click. I had to bring them down to earth with harsh truths, i rewrote their entire site using SEM tools in mind - with key words and phrases like "Altcoin exchange" and using the names of the top 100 altcoins across the site.

SEO

Search Engine Optimisation is the name given to increasing the value and raw volume of your organic traffic. A successful website always wants as many of the most likely consumer base to encounter their product because that’s the hardest point of digital business. Your websites SEO is determined by crawlers which regularly check up on your website and update their index which is later used by an algorithm to order results when someone ‘googles’ something.
Today I’m going to be talking you through some key points about SEO that I personally audit for businesses.

Domains

Https://Www.Example.Com is an example of something we call a ‘root domain’ which is made up of protocol (https://) subdomain (www.) domain name (example) and top-level domain (.com). These are the basic parts. It’s important that the protocol is the best and safest it can be or else google will punish you. It’s also important your domain name and top-level domain are appropriate and readable. The words used in your subdomain can also affect how customers interpret your website, websites can be named after their market base for easy marketing. In addition, the age and previous registrations of your domain matter. It’s important these factors are appropriately considered in your website. Be minimal with subdomains.

Targeting

Google knows where it’s users are and what they’re using from their browser data, IPs and MACs and then matches them with websites in their areas or appropriate to searches. Ever since the infamous 2016 update ‘Possum’ it is not something you can ignore. Even jobs based websites had to use the meta data ‘Jobs Schema’ (from 2017 onwards) to tell google where your website was focused. Location specific landing pages matter. You have to pay credence to DNS (domain name server) and Glue to keep TTL (time to load) and mobile in mind, especially with more mobile users than ever. CMS (customs) is also part of this discussion: themes and plugins are a factor in Google’s ranking. One way to improve TTL is through CDN’s and we have to consider how we approach them to rank better. Sometimes, you might face penalties and there are ways to know; that’s a little too hard to explain here but PM me for more.

Content

Nobody loves a book more than google. Robots will read all your website, even the stuff humans don’t bother with. Things like duplication will annoy Google who doesn’t like reading things twice. CTA’s (buttons basically) have to go somewhere nice and if they don’t work properly google will punish you. Human biases are important too. The user experience will effect their retention and Google will clock that. There’s also lots of minor things that can stack up: Filenames (help you rank on Images) Thin content (Google sees it as lazy) phrase diversity (spamming key words is noticed) and URL structures too! Make sure your in and outbound links are healthy as well as having keyword mapping where you assign the correct words to the right pages. Make sure your anchor texts (viewable when linking) are descriptive yet succinct. And finally: link velocity, a healthy eco system of link building is important to longevity and renewed SEO.

Technical Stuff.

Consistent anchor elements are important to prevent 404s. Don’t use abbreviations with naming files and folders. Limit use of dates for file folder names. Your site architecture has to be simple and close to the root domain so the click depth isn’t too great! Links to and from your site can’t be dead ends, and use breadcrumbs! Be wary of canonical issues from similar content across multiple URLs. Treat Cookies and Session IDs properly, privacy laws are ever changed and mismatching them can be dangerous. There’s lots more to go into like header status codes, site maps, GSC Crawl Errors but Reddit has a text limit so I’ve deleted some of my post.

PM me if interested in my services or with questions.

2020.09.11 04:32 PrairieChild [RF] Pale in Comparison

Winter had sucked all the color out of the world.
The prairie in the glory of midsummer had been a surge of green, summer winds sending pulses through the tall grass, causing it to wave like an underwater kelp forest in a strong current. Now, however, it had relinquished its blooming majesty, its former radiance dulled to straw the color of a deerhide. The flowerheads were stripped of their colorful identities, appearing like sepia photographs of themselves; the ghosts of summer past. The sweetclover, which had extended from one horizon to the other back in June, covering the prairie in a blanket of gold, was now skeletonized, its broken-off stems rolling like tumbleweeds in the winter gales.
Trevor was over it. Another South Dakota winter, another four months until the snows would cease and the ice would melt in the creek. In March and April, the spring blizzards would bury the world and on the subsequent sunny days, the combination of blue sky and white land would be startling, like finding oneself living in the center of a bicolored flag.
But for now, a capricious midwinter thaw had left snowdrifts only in the prairie draws, on the north-facing ridges, in the shadows of the ponderosas that speckled the hills. And around the trailer, mud. In a few nights, a deep freeze would turn the sides of the tire ruts into knife edges, testing the suspension of any vehicle that took the approach too fast. Still, that was better than the loamy mud, which could imprison even a 4x4 until freezing cold or drying winds finally freed it.
The view from the front porch could be gorgeous. Back in July, when the church group from Virginia had constructed a wheelchair ramp for the trailer, the evening sun had set the prairie on fire, its light reflected by a thunderstorm hanging in the sky as if by a puppeteer’s strings. “God almighty,” the youth pastor had exclaimed. But now, grays and browns mingled in a decidedly drab palette. Over at the little bird feeder, the goldfinches were no longer yellow-and-black exclamation points, but had acquiesced to dullness, dressed for a time of year when vibrant color seemed to be outlawed by some unseen authority.
Trevor stared at the expanse of mud that spooled out from in front of the trailer and unwound into a ribbon that led over the hill toward the old sundance ground and, eventually, the paved road. He wondered if he would get out today. Always a calculation this time of year. Driving on the muddy channel that was his approach was out of the question; he would set a course across the grass, which would provide enough barrier to keep his tires from sinking in again. Two-tracks radiating out onto the prairie showed how many times he and his family had taken this course of action since the last snow.
It felt ironic that their approach took them by far the long way around – heading north to go south; harder than it needed to be, like so much of life around here. But the way south was blocked by Roanhorse Creek. This wasn’t all bad; the creek provided nice wading in the summer and water for the horses for most of the year. It also gave rise to the only trees on the property, although the cottonwoods whose leaves whispered in the summer breezes now stood dumb and impassive, and resembled skeletal wraiths at nighttime.
A horse would make it, of course. He could saddle up the buckskin, ride cross-country and be in town in twenty minutes. But that would be silly…he snorted at the ludicrousness of this thought. First of all, he had to go way beyond town today. And even if he were just going to his old job at the tribal building, was he supposed to just hitch it up outside for the day? Tie its reins to one of the smokers’ benches by the entrance? What was this, 1895? No, better not to risk TȟatéZi getting stolen or having some gang sign spraypainted on it or some shit. Besides, he needed to pull into his job interview looking halfway decent, not spattered with mud and smelling like horse sweat.
Trevor regarded his truck, sitting smack in the middle of the sloppy mess. Fuck, he thought.
Still, he didn’t really have a choice today. No job interview, no job. No job, no funds. Another calculation, but this one was straightforward. He went back into the trailer and made his way to his bedroom in the back, passing his brothers in the living room. One was sleeping on the couch and the other was crashed out in the recliner, oblivious to the flickering hearth of the muted TV. Let ‘em sleep today, Trevor thought.
In the bedroom, he stepped across piles of clothes – some clean, some dirty – and over the miscellany of his life; a pile of old DVDs, a defunct gaming console, a canister of Bugler and squares of broadcloth for the tobacco ties he was supposed to make for ceremony, a scattering of empty Mountain Dew cans, a 24-pack of ramen, a basketball.
He hunted around in his closet for the dressy clothes that he knew were there. He had worn them once, on the day of his high school graduation, three years before. And there they were; a purple button-down shirt, a solid black tie, and black chinos. Further rummaging found him a pair of brown loafers and a tan braided belt. He would look sharp for this interview – couldn’t hurt.
Trevor took a quick shower. The hot water always took forever to come and once it did, didn’t last long. He got dressed hurriedly, glad the tie that had come as a set with the shirt was a clip-on, and ran a comb through his hair. It wasn’t long enough to do much with other than backcomb it a little with some hair gel, but he figured that looked better than not. He considered putting in big stud earrings to look extra fly, but decided again it; might not be the right look for the occasion.
Now fully dressed and ready, Trevor took stock of his appearance. His summer tan was long gone and his skin was as pale as the white kids he had met during his one semester of college. The same change of season that had desaturated the prairie and garbed the birds in dull colors had undone all those days spent out in the badlands sun – working with the horses, swimming at the dam, helping keep fire at sundance. Too many French fur traders in his lineage. He recalled the book that his eighth grade teacher had assigned them – Part-time Indian or something – and thought, Yup, that’s me. Indian in the summer and wašiču in the winter, like changing plumage.
Trevor envied his brothers their melanin. He had learned that word in one of his college classes and now thought of it nearly every day. Travis was a rich brown complexion even in the dark days of midwinter. Trenton was in between the two but had jet-black Lakota hair and definitely looked “ethnic,” enough to be followed around stores in the border towns. Trevor knew it was his privilege to be exempt from such treatment, but it bugged him nonetheless. He hadn’t asked to be light-skinned. His brothers called him žiží – a reference to his tawny hair. They had gotten into scraps over this, and Trevor even bloodied Travis’ nose in one such altercation. Once one of them had even called Trevor a “half-breed” but Trevor retorted with “Fuck you, boy, you got the same blood as me. Fuckin’ dumbass.” This seemed to put the issue to rest.
Trevor’s brief stint at college had been at an out-of-state school, which now struck him as an ill-advised decision. At least South Dakotans had some experience with Natives. Even the East River kids had at least crossed paths with one at some point, and didn’t think of Indians as something from the pages of a dime novel. Trevor was the first Native in many years – maybe ever – to attend the small-town liberal arts college in a neighboring state. He thought the fact that the college was reasonably selective would mean that the students were smart enough not to ask dumb questions. He was wrong.
The queries were predictable enough, clichéd even; Are you really Indian? (Yes) Do you speak your language? (No) Did you get in because you’re Indian? (Who knows? I’m pretty smart and got good grades.) Does the college have admissions quotas for Indians? (If it did, you’d think more would go here.) What’s it like on the reservation? (I don’t know; different.) Do you prefer “Native American”? (I find the question annoying, to be honest.) Do you like Leslie Marmon Silko? (Who?) Have you seen Dances with Wolves? (Some of it.) Do you know a guy from Pine Ridge named Verdell? He used to work with my dad. (Maybe) His last name was something Horse. Running Horse? (No)
Fielding these questions was exhausting and added another layer of weariness and alienation to his college experience.
He found himself having to answer such inquiries from his roommate, classmates, professors, his R.A…Sometimes they were cloaked in well-meaning concern (I bet you get tired of all these questions, huh?) but they were always there. Most evenings, Trevor would retreat to his room and call his mom. His roommate, Skyler, a cross-country runner who was handsome in an unspectacular way and who monitored his water intake religiously, was hardly ever around. He seemed to have no trouble making friends in college and reveled in the social opportunities around him.
In his phone calls back home, Trevor found himself experiencing a homesickness that inhabited the pit of his stomach like a hunger pang. He had never been gone from home for that long. Really, his only trip away had been the summer before his senior year, to a weeklong STEM camp for Native kids that one of the state colleges had put on. But that had been with a half dozen other students from his high school. Here he was alone.
The subjects of their conversations would leave Trevor feeling a gravitational pull toward home: Trenton got into a fight at school and got suspended. Travis is drinking again. We had sweat for your auntie because they have to amputate her leg after all. Those dogs were back again. Everett hit $200 at the casino on Tuesday night but of course he put it all back in. They’re having a basketball tournament for that boy who got paralyzed in that wreck. Our hot water heater went out but uncle came and fixed it. They still haven’t found that Two Arrows girl that went missing. Travis wants to go up on the hill this spring – maybe that will get him to quit drinking.
Good news, bad news, mundane news…The latter tugged at him the most. Like many who grew up on Pine Ridge, he had a love-hate relationship with the reservation. It was the home of his people after all, and could be so beautiful (“God’s country,” as it was called by even those who had no time for the white man’s God). But the hardships, the tragedies, the death…it all wore away at your spirit, hardened you. Still, the news of day-to-day life going on in his absence; a school powwow, a bingo tournament, tribal council drama, rumors of a Dairy Queen opening. It made him miss home in an ineffable way.
The last vestige of his indecision evaporated after a particular conversation in the lounge of his dorm. He had been sitting on a beanbag chair, discussing random topics with two friends (at least, he considered them friends, in some ill-defined adolescent way). They had all left a dull party that hadn’t livened up even after a couple of drinks, but still felt heady and obligated to prolong the night a little longer. So, they were shooting the shit, in a garishly-lit common space that smelled of burnt popcorn, and Trevor was feeling rather collegiate. An off-campus party, late-night conversation; weren’t these the trappings of university life that he had seen in teen movies, if a much more prosaic version?
Kayleigh, tipsy off Jäger bombs, started the chain of events that would unravel his college experience with a simple, but pointed question: “How Indian are you, anyway?”
Colton snorted at this comment. “Kay, you can’t just ask that!” But he was clearly more amused than disapproving.
“You mean like my blood quantum or what?” Trevor asked.
“Is that what you guys call it?” said Kay, now playing the innocent party. “I just mean, like, you say you’re Indian, I mean like I know you are, like, I know you are on paper…” The alcohol was causing her to trip over her words but she plowed on. “I mean like, okay, if I were to like, run into you on the street…” Kay was now gesturing expansively, as if the meaning of what she was saying wasn’t explicit from words alone. “Like, I wouldn’t be like, ‘Damn, look at that Indian,’ right? I’d just assume you were a white guy. I mean you know what I mean? Ugh, I’m not making sense.”
She was making perfect sense. Colton looked embarrassed, and for a second, Trevor thought he might shut Kay down. But instead, his inhibition similarly worn down by a few shots of German 70-proof, he followed suit. “I think what Kay’s drunk ass is trying to say is, like, your ancestors are Indians, right, like in the history books. Like Geronimo or whatever. But do you consider yourself one of them? Or are you, like, their descendant?”
Trevor could feel the ball of rage growing within him, a sea urchin radiating spikes in his gut. Stop talking, he thought. Just stop talking.
Colton continued, heedlessly. “Okay, so like I’m Irish but I’m not like Irish Irish, like a leprechaun or some shit. Like my ancestors…”
Trevor stood up, his fists balled. He was now stone-cold sober but his anger was its own intoxicant. “It’s none of your fucking business. It’s none of your business what the fuck I am!” He was shouting; he couldn’t help it. He picked up a half-empty can of PBR and threw it at the wall, slamming the door to the lounge on his way out. The sudsy contents of the can leaked onto the ugly orange dorm carpet, as Kayleigh and Colton sat in stunned silence.
“Jesus,” said Colton finally. “Just trying to ask an honest question.”
After that, Trevor had holed up in his room for a few days, skipping classes and avoiding other students. When he told his mom he was dropping out, she hardly sounded surprised. He knew she would be glad to have him back home; the prodigal son returning. Trevor, the one who had his shit together, who had gone to a STEM camp and was almost salutatorian. He knew she thought that once he got back, he could do what she couldn’t; get Travis on a better path, bring another income to the household, fix what needed to be fixed around the trailer, shoot at the stray dogs when they came around. It would all fall to him. His failure was their blessing; they would lean on him as long as he could stand.
So here we fucking go, he now thought, patting his gel-stiffened hair and giving himself one last hazel-eyed glance in the mirror. Gotta get that bread. His brief stint at the tribal building hadn’t panned out. He was a good worker but wet weather made his road too sloppy to get out easily. Too many latenesses had translated into a pink slip. “Shit man we all got bad roads. Gotta leave earlier,” his boss had said.
So, lesson learned, he was giving himself extra time getting ready for this interview. Really, the lady had just told him to come by “around mid-morning,” so he’d probably be okay. The job was off-rez, down at the county livestock auction and sale barn in one of the closest border towns, “white towns,” as Ridgers called it. It was mostly going to be paperwork – inventory and itemizing and that kind of shit – but it was decent pay and Trevor hoped that he could transition over to working with the animals before long. On most days, he preferred their company to dumbass people.
Grabbing his bag, Trevor stuck the loafers inside with his other miscellany. He would need to wear his cowboy boots across the muddy expanse between the bottom step of the porch and the door to his Blazer so he jammed his feet into them. Outside, he walked gingerly so as not to stain his black slacks with muck. Once in the driver’s seat, he figured he would leave the boots on for the drive, since they were already smearing mud on the floor liner, and in case he got stuck and needed to get out. Trevor knew that the people who worked at the sale barn were as countrified as he was and wouldn’t judge muddy boots under most circumstances, but he also knew that being from Pine Ridge meant he had to put his best foot forward, literally in this case.
Trevor fired up the Blazer, put it in four low, and gunned it. His tires found grip and he jerked along, slimy divots of earth spattering his windows and roof like hail. His windshield wipers left a pasty smear that obscured much of his view, but he practically knew the way by feel. As soon as he could, he bumped up onto the grass, gopher holes and clumps of prairie bluestem jolting his ride, testing what was left of his suspension. When he finally hit the pavement, the smoothness was startling as it always was, like a TV being suddenly muted, like silence after a door slamming.
He cruised through town, passing the gas station, the other gas station, the commod building, the quonset hut, the old BIA headquarters…and turned south into Nebraska. He tried to ignore the persistent squeal under the hood that had gotten worse lately. The overcast sky reflected the dullness of the land – as below, so above – and Trevor alternated between zoning out and counting hawks on telephone poles. A handful of miles south of the border, the vehicle gave a jolt and Trevor felt a temporary loss of control. He hit the brakes and steered toward the shoulder, but the Blazer was suddenly steering like an army tank. Fuck, he whispered.
Once he wrestled Blazer off the road, Trevor got out and popped the hood. He already knew what he would find under the rising steam. “Fucking serpentine belt,” he hissed to the universe. Trevor was good with cars but he didn’t have the tools for this fix. Luckily, he thought, out here in the country, somebody who did would be by soon. Lots of Natives on this road, maybe even a cousin would happen by who could at least give him a ride to town. Trevor thought of calling his dad’s brother Everett on his cell, but figured he’d give it a bit. He hated the thought of owing Uncle Ev anything.
Sure enough, in a few minutes, a gunmetal gray truck passed by slowly, hit a u-turn, and pulled up behind him. Trevor felt a twinge of envy over this late-model Dodge Ram MegaCab with duallies. It had county plates on it, so the cowboy-hatted driver was a local guy, and as he got out, his Carhartt overalls and mud-caked boots identified him as a rancher.
“Trouble?” MegaCab asked, giving Trevor an easy smile.
“Serpentine belt busted,” said Trevor, unconsciously smoothing out his rez accent in favor of a more neutral affectation. Code-switching – another term he had learned at college (by the professor who asked him if he prefers “Native American”).
“No shit, huh?” MegaCab considered this information. “I got nothing for that but I could give you a ride somewhere. You call anyone? Someone coming after you?”
“No,” said Trevor. “I’m trying to get down to the sale barn for a job interview.”
MegaCab looked at Trevor as if for the first time. “Oh ok so that’s why you’re all fancied up. Well, hop in if you don’t mind leaving it here.”
Trevor considered this. He was off the rez so there was less of a chance that the Blazer would end up with busted windows or slashed tires. And he was eager to get his interview over and done with.
Before he could answer, MegaCab added “I have to stop in Whiteclay first but then I’ll take you down.”
This was only a few miles out of the way so Trevor assented and climbed into the rancher’s idling behemoth. It still retained some new-truck smell, mixed with a tinge of manure and rich earth. Really, it was almost luxurious.
MegaCab flipped a u-ey again and headed back north toward Whiteclay. Formerly notorious for copious alcohol sales to people from the dry reservation whose border it sat on, Whiteclay’s package stores had been shuttered after the state had revoked their liquor licenses following years of protests over their depredatory business model. Now, it was just a town of a couple small stores and fewer than a dozen permanent residents, its streets empty of vagrants, its ghosts banished.
“So, you from Hot Springs?”
Trevor momentarily wondered where this question had come from, and then remembered that he had 27-plates on the Blazer – Fall River County, a relic of when he bought the car from a white lady over there. He had kept the off-county registration because the plates were far less likely to get you pulled over off-rez than the infamous 65s of Oglala Lakota County.
MegaCab continued without waiting for an answer. “I used to go up to Hot Springs a lot when my dad was in the V.A. hospital up there. Nice town.”
“Yup, it’s pretty nice,” said Trevor, wondering if he would have to sustain this small talk the whole way.
Luckily, MegaCab took it from there, reminiscing about his high school football team dealing Hot Springs a particularly lopsided loss, and then they were at Whiteclay. Trevor played around on his phone while his driver of the moment went into the little grocery store. He looked up his old roommate Skyler on Facebook (why, he didn’t know; certainly not to friend him) and then Googled “Pine Ridge South Dakota Dairy Queen” just to see if there was any truth to that rumor.
MegaCab returned with some mail – Trevor had forgotten that there was a little post office in there – and they turned south toward Rushville.
Two miles and five hawks-on-telephone-poles into their trip, MegaCab got chatty again:
“I still can’t believe that the state revoked the liquor licenses. They had no legal right to do that of course, but just like everyone else these days, they bowed to the pressure from liberal special interest groups. Those store owners – my brother was one of them – followed the damn law to a T but still got their rights taken away. They’re the real victims in all of this.”
Trevor, whose father was found dead in Whiteclay when Trevor was ten years old, didn’t answer.
“You know it’s just going to push the problem down the road. These Indians are gonna get their liquor one way or another. You guys must see that all the time up in Hot Springs.”
These Indians. You guys. Trevor suddenly recognized MegaCab’s presumption, and wondered when if he should correct it.
“If they wanted to buy millions of cans of beer in Whiteclay every year and drink themselves to death, shit, I say let ‘em. It’s a free country, right? Those AIM types are always going on about Native rights and shit, y’know? Well shit, you have the right to drink and die if you want. Not saying that I want that for those people or anything, but the nanny state can’t be protecting everyone from problems of their own making.”
Trevor, whose brother had first gotten jailed for drunk and disorderly at age 14, two years after their father died, said nothing.
MegaCab continued to rhapsodize about “the Indians” and their problems, adopting the tone of an expert, one who knew all about them. Trevor felt the blood rise to his face. Some coloration at least, he thought darkly. In the pit of his stomach, the sea urchin had returned to stab at his insides. What must it be like, he wondered, to live a life in which people aren’t constantly telling you who you are, naming your characteristics like symptoms, trying to trap you like a spirit in a photograph?
The Blazer came in sight on the shoulder ahead. “Can you let me out at my ride?” Trevor asked, his voice hardly recognizable to his own ear, like hearing himself talk underwater.
“Sure, you need to grab something out of it?” said MegaCab, reluctantly pausing his diatribe.
“No it’s okay,” replied Trevor, “I’m gonna call someone to come help me fix this after all.” He fiddled with his phone as if to underscore this intention.
“Well, if you’re sure,” said MegaCab. “And hey,” he added as Trevor stepped down onto the running board. “You be careful around here. One of these rezzers might see you here all by yourself and try to mess you or your car up. And watch out for drunk drivers. You just never know with these Indians.” MegaCab gave a serious nod to accentuate this show of concern. Then he wished Trevor luck and drove off.
Trevor watched the truck recede into the distance until it was merely a gray speck between the monochrome earth and the steely sky. He sat down in the cold front seat of the Blazer and looked into the rearview mirror. Hazel eyes stared back at him under a pale forehead. Fuck it, he thought; people are dumbasses. Let ‘em believe what they want; that he was from Hot Springs, that could be was related to that Apache, Geronimo, that he was only Indian on paper. Trevor saw what they didn’t; the hidden depths beneath the surface, and in their faces, in the spaces between their words, their ignorance displayed like a tattoo.
In another minute or two, he would call Uncle Ev for a ride. In another hour or two, he would be offered a job at the sale barn that would bring another income into his household (and buy him a new serpentine belt). In another day or two, he would finally finish the tobacco ties for ceremony, at which he would pray for Travis’ sobriety and his auntie’s diabetes. In another month or two, the lengthening of the days would be unmistakable.
Spring would come as it always had, first heralded by a single meadowlark piercing the predawn silence with his song. This would be followed by a green sprig on the prairie, pushing up, perhaps, through snow. Then a cluster of pasqueflowers appearing suddenly on a hillside, a skein of geese overhead, sheet lightning on the horizon. Small miracles, one after another. Finally, color would surge back into the world like paint scintillating on a canvas, causing goldfinches to glow like stars and evening thunderheads to stand like towering fires.
The brilliant Dakota sunlight would stoke the melanin in Trevor’s skin, and nobody would mistake who he was. He would go up on the hill for two days and nights with Travis that spring, and Trenton would keep fire for them. He would pray for the coming year, for the survival of his people, for enough blessings to outweigh the hardships. And there, among a sea of undulating green, facing the crimson blaze of sunrise, he would again know himself and find the strength to carry on, in the face of all the peculiar indignities of this world.

2020.09.09 23:35 borednightnurse1990 Week 1, Day 2: Payback is best served with a TKO.

PROLOGUE
I know i promised in Day 1 Week 1 to post some short stories and cap it with one big story of epic proportions. But ever since i said that, i couldnt get the “big one” out of my mind. giggity
Maybe its because of how much of it was “could you believe this shit?” material. Its a story thats still going on and has been for 2 years now.
Advance warning: if you somehow dont agree with me as a person, or my story, try to voice your disagreement in a civil manner. If you can’t, just stick to PMs or keep it to yourself. Dont blast it in the comments section. This is a nice community.
No TLDRs, if you have the time to be on Reddit, you have the time to read this. Zero apologies for grammar or spelling mistakes either. Heard you can keep them and combine them with spelling/grammar mistakes from other posts, and eventually you can have a ball of grammar and spelling mistakes that you can keep as a pet and will keep you warm at night.
BACKGROUND
I am a mixed race woman: half white, half mixed asian, (redacted) years old. I am also what hard core old schoolers would call, a sinner. Yeah. Been living in sin with a partner i married in Las Vegas, USA some years ago. If that doesnt make your standard issue hypocrite cringe, we are also both active duty members of our country’s military. I work in a combat arms unit, and she drives a fighter plane for a living. Yeah, so just your basic, standard issue “baby killing lezzies”. Actual words thrown at us before.
PART 1
Once we got our permanent duty assignment, we decided to buy a property together. We bought into this nice semi gated community close to the base thats populated by about 95% active duty or retired military. We were welcomed warmly into the community, except for our immediate neighbour to the left.
We’ll call them Kevin and Karen. (Very original). They were about 50 years of age, have 2 kids away in university and 1 kid who flunked his ABC’s living with them in his late 20’s.
Kevin is active duty as an Air Force officer. I believe he’s a tech of some sort. Aren’t all Air Force dudes a tech of some kind? And Karen is a “professional influencer” who deals in MLM, fitness and travel stuff.
The fact that they have problems with us as their neighbours was evident from the beginning. Here’s the indicators of no particular order:
-our realtor and HOA organized a welcome party for us at the country club with welcome gifts and cards. The card is massive with welcome messages from everyone. Kevin and Karen just signed theirs with: “Welcome! Kevin and Karen”. They were also notably absent, with everyone else who was absent having a valid excuse.
-within our first month of living in our new home, we were immediately bombarded with complaints from the HOA. Since our immediate neighbours were: Kevin and Karen to the south, an empty lot to the north, a small wooded area behind our houses, and people across the street we quickly became friends with, its obvious to see where the complaints were coming from. We were told were exposing the kids in the neighbourhood to indecency and even nudity. (This is about me and the partner going for runs in the weekend. Our standard running attire is pretty normal, sports bra covered by a tank top, and shorts or yoga pants. We took this one pretty hard since even facing accusations of child molestation/exposure is a serious career ender). We were told we were clogging up the streets with illegally parked cars. (Its about that one time i quickly drove home to grab the lunch i forgot, and i was in a rush to park properly, in front of my own property). We were told we were neglecting our part in maintaining our home, driving down property values in our neighbourhood. (This one i have no idea). We were told that we were stinking up the neighbourhood with bad smells. (That one time i went outside to use the grill and cook a smoked fish i picked up from an Asian store.) We were told we play our music too loud and its bothering people. (Okay, ill give this a shot that we may be at fault for this one because of a couple of times where we hosted a weekend party). Its all a lot of small stuff too much to mention, but its obvious that someone has a problem with us.
-They also filed a separate report for “indecent exposure” with the cops. Source of the complaint? Milena and I were having some fun, healthy grown up times that probably went a bit too loud at some point, and i ran into the kitchen to grab a glass of water while still in my birthday suit. That brief 10 second period where i happened to be in view through the open kitchen windows, AT 1 IN THE MORNING, is apparently enough to line us up right there with sex offenders.
I did a bit more analysis over this after the cops left. If were considering that our walls are paper thin, which it isnt. I’ve had times where Milena is playing Warzone at full volume in the den and you couldn’t hear anything from two rooms over, let alone from outside the house. But lets say that maybe we were actually that loud. My kitchen window at the time only had one window that was open and uncovered. This is a window that faces K&K’s house. Between their fencing and fruit trees, the only way you could see into my kitchen from that window is if you’re viewing it from a second story vantage point. The second story of their house has NO windows facing any of my kitchen windows. ZERO. So that means that one, or both of them, by some miraculous reason, heard and got awakened by the fun times going on, stepped out of their house and somehow peeked into our house either through or over their fence.
I GAVE THEM A SHOW AND INSTEAD OF TIPPING ME, THEY CALLED THE COPS AND GAVE ME THE WHOLE SHAFT!
Motherfuckers.
And finally, the dog. I have a 7 year old Husky-Lab mix. He has been fully trained by an actual professional school to be a therapy dog. He is trained not to bark under any circumstances except for the emergencies he is trained to respond to (fire, me or my partner being rendered unconscious). So its a surprise when the complaints against us started to include my dog and his “excessive barking”. And then it escalated to his “unattended droppings”. And then how he looks like a “threatening breed”. Keep in mind that this dog and his breed has been cleared by our HOA. And even if they didnt, they can go kick rocks since he’s a registered therapy dog used for a legit medical reason.
We willingly offerred the HOA to submit to them all copies of our outside camera’s feeds for a month to see if there’s a pattern of un neighbourly conduct we might be doing and not aware of. The HOA is pretty happy with our proposed solution and took us up on our offer. We didnt change anything with our lifestyle and after a month, they were happy with what they saw and concluded the complaints against us are baseless. This is also when the person from HOA let slip that ALL the complaints came from ONE residence where their owners are known for being “squeaky wheels, that need a lot of greasing to keep happy”.
Well, someone has a grudge against us and we dont know what we did wrong against them. It eventually escalated with the culprits outing themselves.
CONFLICT 1
This all came to a head sometime in April 2019 when I was mowing our backyard and doing some spring house maintenance. I looked across the fence and noticed that ALL of K&K’s backyard camera’s were pointed at OUR yard. I thought it was odd so i asked Kevin about that when he stepped outside to have a cigarette. I was immediately met with shouting and curses.
“Its my cameras! Ill point it wherever i want! And right now, i want evidence that you’re intentionally luring wildlife destroying my yard! And put some fucking clothes on!”
I was puzzled about that and asked him what he meant. He kept shouting and through his raving, i came to the conclusion that he had a problem with my birdfeeder. Now, i cleared this bird feeder with the HOA. They approved this. This feeder was built in a way, that ONLY birds can access it. Squirrels maybe, but we dont have any of those in our area. There’s not a lot of wildlife populating that small wooded area behind us. So there’s no way that something big enough will be attracted and have access to my bird feeder and destroy anyone’s property. Its not like we live in a place where wildlife - human interaction is a problem. Besides, what property was he talking about being destroyed by this non existent wild animals? He has a rock garden and a couple of fruit trees in his completely fenced up yard.
He ended his rant with the threat that if he sees any one single animal in his yard that was there because of my feeder, he’ll come over to my house, destroy my feeder, and destroy anything else he wants just to see how i like it. Or if he sees my dog anywhere near his property, he will call Animal Control to take him away, and if my dog continues to be a “threat” to him, he’ll shoot him regardless of whether AC is on the way or not.
After over a month of this irritation + this confrontation with him, i decided that i wont be a prisoner in my own home anymore because of the whims of one man. I sent my own complaints to the HOA telling them about this interaction that ended with a threat to my safety and my property, and the improper behaviour of my neighbour. I was told that if it qualifies as an HOA issue, they cant mediate in “he said-she said” scenarios without proper evidence or witnesses. But, since it sounds more like a safety and well being issue, it sounds more like something the police should be involved in. But they wouldn’t be able to do anything except file a first complaint unless something physically happens/happened to us.
Well, isnt that just amazing? For the following months, my hands were tied and there’s nothing i can do but file a complaint or file a response to a complaint filed against me at the HOA. Even the HOA people, who thrive on drama like this, were getting tired of it. I got to make friends with a lot of my neighbours during these months, attending community events, and got the picture that K&K were bullies. Theyve always managed to strong arm people, and they seem to pick on people who are just “different”. Either people of colour, different beliefs, someone they think is inferior to Kevin’s status as an AF officer, or, i dont know, maybe someone they just dont like.
One of those guys i had the chance to chat with told me (paraphrasing): “Look. I dont know why is it that K&K like to pick on people who are obviously different when they’re obviously different themselves. Maybe, they like being big fish in a small pond? But, look at it this way, if i like to target “different” people because of the way they are, then you and Milena (my partner’s middle name) are obviously going to be the crown jewels in my collection. You both are uniform wearing, card carrying open and unashamed lesbians, and in your case, a person of quite a petite stature who is also of mixed ethnicity. If i attended a KKK sponsored bingo night in Alabama, your guys’ description would give me a blackout win. You’re with (my unit) right? You’re giving them a bad reputation by eating this guys’ incoming more than you have to. I think its time for you return fire and destroy this POG.”
PAYBACK 1
I was still at a loss as to how to process this message and then something clicked. Its already approaching Christmas and the active/retired gunfighters in my neigbourhood likes to host a “King of the Cage” charity fight. This is a big deal for our neighbourhood and our base, with caterers being hired by the HOA and medics volunteering for this fight being excempted from all duties by their chain.
This is how it goes: MMA fight rules and equipment + King of the Hill rules. No weight classes, MMA rules + referees, and you have to sign a waiver. King of the Hill rules is you have to win 2 out of 3 fights to advance to the next heat, until the semi finals when 1 loss will get you out of the running regardless. You go from one fight to the next and the only time you get to rest is if you get to the semi finals.
This is organized by my neighbourhood’s HOA, but has gotten so popular over the years and spilled into the base personnel because of the sheer amount of officers and active duty personnel living here. Everyone pays a fee to get their name in the fight, the pot is matched pound for pound by the HOA fund and (unofficial) senior NCO and officer’s fund, 25% of the proceeds goes to the winner, and the remaining goes to whichever charity is being hosted at the time. Everyone who is active duty both in the neighbourhood and people working at the base is “encouraged” to sign up. Heavy emphasis on the “encouragement” for both occifers and senior personnel. You better have a good reason for declining to fight since this is the one time where troops have a good chance of punching you in the face with no repercussions. And punching someone more senior than you in the face is always good for morale, and gives troops the impression that their leaders are still grounded and human like they are. Partner and I sign up once they announced they are now taking names.
Both my partner and i have good backgrounds when it comes to fighting and martial arts (in the ring and real life). Milena regularly does boxing drills as part of physical training, and has been fighting in karate and tae-kwon-do tournaments since grade school. Im the more proficient one when it comes fighting. Some people metaphorically give their kid at birth soccer balls, or a basketball, or whatever it is that they want to impart to their kids as a lifelong skill. Im only exaggerating when i swear that my dad gave me emei daggers when i was born. I have a strong background and training in muay thai, krav maga, bjj, kali/eskrima, and wushu (specialized in sword and dagger routines). Ive been competing in wushu and kali tournaments since i was 10, bjj/grappling since high school, and continues to compete in kali and bjj up to now. Ive also used krav maga and kali drills in work related fights and routinely use it when were doing MMA sports days at work. So, despite my deceptively petite stature, i can handle a LOT. Pun intended. Get over it. 😘
Anyway, with a little bit of finagling, i was able to convince several key fighters to let Kevin win their bouts. Kevin is pretty good from what i can tell, although hes more of a stand up fighter instead of a submission/ground and pound fighter. He just basically overwhelms people with his size and weight. Whenever he is down on the ground, he can easily strong arm people into submission. He’s about 6’5 against my 5’5 if im thinking tall thoughts. He weighs around maybe 250 lbs, against my 160 lbs soaking wet. Im pretty much physically half the person that he is. Lol. I can already tell that no amount of skill, training or wishful thinking in the world will let me win over someone who can easily overwhelm me with their innate weight and size. I face him for the first time in the last couple of matches before the semi finals, with several wins already under both of our names. The semi finals bracket is composed of 4 fighters and 1 random semi finalist whos been eliminated but won the selection fights, with the top 2 advancing to the finals cage.
So i huddled with Milena and came up with a plan that heavily revolves around exploiting the selection fight. This “selection” fight will still be MMA rules and refereee and have the additional risk of bare knuckles and fighters’ choice of sparring weapons. (Padded kali sticks, blunt knives and swords, padded shinai (kendo) swords, shock knives, and pugil sticks.) This risk is offset by “protective padding”, but anyone whos ever sparred at anything can attest to how they only minimize the hurt. It still hurts. People who have been knocked out earlier in the process can “buy” into the selection fight twice and get another shot at being the fight night champion. People who have been knocked out from the semis can only buy in once. The buy in is twice the registration fee. The selection fight mat is “live” for as long as there fighters fighting on it, and as long as there’s still fighters qualified and willing to buy in. The selection fight will be closed for business once the final matches start. I think theres some other rules and conditions im forgetting to mention.
The shock knives were a popular choice and had to have batteries swapped out a few times. People were just having the time of their lives shock knifing colleagues and even bosses. My favorite is when a mat had to be taken out of commission for cleaning and disinfecting. Some grunt shock knifed his buddy, and then drove a knee onto his gut. Buddy reacted the way most human bodies do when under stress: he vacated his bowels. Yup. He pooped himself. Poor guy. Bet you he’s gonna have fun with his new call sign.
The time came when i had to fight Kevin. I have yet to lose a fight while Kevin is 1 and 1. One more loss and he’s out. As soon as the ref said: “Fight!” I immediately knelt and tapped on the mat. I just threw away my first fight against Kevin. I went against another fighter and won that one, and then tapped myself out again when i had to face Kevin one more. He didnt say anything to me but the looks he was throwing me while almost sneering were enough to tell me that if there arent any witnesses, he would have been jumping down my throat with insults.
I went to the selection fight mat and bought myself back in. There was some other people in line and i quickly won against the ones i was matched with. If anyone is still reading to this point and counting, i now stand as King/Queen of the Hill, with the chance to be the dark horse fighter in the finals unless someone goes against me, and with one more buy in left if i get knocked out in the semi finals fight.
And wouldnt you know it, Kevin got a thrashing in that one last fight before the semis. He bought himself back in and is now facing me on the mat. His weapon of choice was the pugil stick. I swapped out the shock knife ive been using to a pair of kali sticks. We were both padded up with our heads, upper body, and shins covered with padding + a groin protector.
Ladies and germs, if youre still reading, let me tell you that this was the fight of my life. Ive done my share of both real life and training session fighting, but this one was the one fight that i will never forget. Its because i was facing someone that has been tormenting me, because of who i am as a person, non stop for months.
He quickly charged at me as soon as the ref blew the whistle. But since he is padded up, hes just a bit slower and clumsier. Exactly how i need him to be. I deflected his pugil stick with my kali sticks. I was able to disarm him with a quick parry —> wrist strike —> disarming twist. Before the ref can blow his whistle, i smacked him on the head with a stick, dropped my sticks, and did a single leg takedown. I made sure to land on him with my entire body weight and my elbow planted on his belly. We are now both unarmed and has transitioned to grappling. Still stunned from the blow to the head, he was simply offering weak resistance. Before he could recover, i secured my full mount on him, snuck in a few hammer fists to the unprotected part of his face, and locked in a textbook American lock. I was cranking that bitch hard until the ref stopped the fight with me staying on as K/QOTH.
I moved on to the semi finals while he bought himself back in. Before you know it, we were up against each other again in the semis and i outed myself again by tapping on the mat. I quickly regained K/QOTH status and am facing him again after he got ground and pounded to submission. This time, he picked the shock knife and i stuck to my kali sticks.
He is a lot more wary this time after i caught him unawares in our first time fight. We spent a couple minutes jabbing and striking to test each other’s defenses. Finally, i caught an opening. He tried to stab at me with the shock knife. I dropped my left stick while sidestepping him, caught his knife hand with my left hand, digging my fingers into his tendons, and while still holding my remaining stick, i hit him with a straight jab to the face, and ended the action by jabbing downwards at the wrist i was holding with the butt of my stick. This caused his wrist to go limp and drop the knife. I have now disarmed him, again. I dropped the remaining stick and while still clutching his now limp right hand against my chest, hammer fisted his right shoulder at the joint, hit him a back fist on his neck, (i believe i hit, or came close to hitting his carotid artery), and followed up with an enpty handed palm strike to his nose. Ever felt ligaments crunching? Feels gross. Sounds even grosser. I broke his nose and knocked him out cold. He’s down and done. TKO is announced and i move on to the finals.
He’s now been medically DQ’ed by the refs and medics attending. Since there’s no more fighters qualified or willing to buy in, i automatically advanced to the last couple semi finals fights. The rest of the night was a blur. I was gassed out by the time i qualified for the finals and got easily submitted with a kimura. To be fair, im not even mad i got so far into a US$25,000 competition only to get knocked out at 3rd place. Im not even mad about the black eyes or sore back or all the bruises.
Because of the payback.
This is sweet, sweet fuckery revenge for me. This son of a motherless whore has been tormenting me and my partner for months, casting a dark cloud in a what should have been a sweet moment for me and my partner both coming off of extended deployments and finally getting some down time together and finally getting to enjoy being homeowners. He has also been bad mouthing(?) us with our neighbours as we later learned. And for payback, i got to make him my bitch, twice.
Part 2 coming up. The title would be: “You f***ing people!” and involves Karen a lot more.

2020.09.04 14:36 Draemeth [For Hire] Marketing and SEO

Alright here is another post
Hey @zekeindahoose, did you send this inquiry to one of the Portland antifa groups? If so, why did you say describing antifa as a terrorist organization is a false “right wing trope”? You know that a self-described antifa is being investigated for murder, yes?

Bodog Casino Review

Among known brands in online betting and casino gaming, Bodog is without doubt one of the best. Since 1994, when Calvin Ayre launched it, the site has gone through many development phases. There was a time when it was one of the foremost online gambling options for folks in the United States; however the site no longer accepts American customers. Its sister site, Bovada, is now left with that task.
Presently, Bodog is entirely focused on the Canadian market and accepts customers solely from this region. Some of the gaming options available at the site include sports betting, casinos, horse racing, and poker. While sports betting has been the primary focus of the site, other features are also very inviting, with casino play now being more prominent than ever.
Below is a comprehensive review of the site, looking specifically what Bodog Casino offers players and whether or not this casino website is worthy of acclaim.

Going Through the Motions

You definitely are going to be impressed when you check out the Bodog Casino website. The home page is very simple, however it makes it very clear what the site is about with bold graphics, as it does its best to place the spotlight over the games it makes available. You will find links to each of the main sections of the site, and a noticeable link to register an account.
If you click the link to open an account, a new window will display and you will have to enter your country of residence, along with other relevant registration information. At present, only Canadian residents may use Bodog Casino.
The sign up process doesn’t take long; basically you just have to provide a few small pieces of personal information. This includes your name, email address, and date of birth among other things. As soon as you’ve concluded the process, your account will be registered and you’ll be able to start betting and gaming as you see fit.

Just One More Spin

Bodog Casino puts its budget to fantastic use, as it provides players with advanced graphics and an incredibly smooth gameplay experience across all casino game games. Focusing in on what is most impressive, table games like craps and roulette, along with card games like blackjack and poker are particularly enjoyable.
Bodog Casino blackjack has also long retained the reputation of being one of the most effective casino games on the Internet, as it never fails to disappoint. Bodog Casino slots are increasingly improving with each new release too, which shows that this is an online casino that is making progress. When it comes to games, Bodog Casino is sleek to say the very least, as through one click of the mouse a game is started instantly (no registration is needed to play for free).

Quit While You’re Ahead

Depositing and withdrawing at Bodog are both straightforward. Visa or Mastercard can both be used to deposit, and the site is excellent at getting credit card deposits processed fast too. A few other methods are available as well, like BillPay and Interac e-Transfer. There’s no charge for depositing, and funds will normally be ready for you to make use of instantly.
Withdrawals are usually processed within a fairly good timescale; you can expect to have your funds within a couple of days in most cases. You can withdraw via cheque or direct bank transfer, as well as Visa. Although it must be noted that only specific Visa cards are eligible though. All customers are entitled to a minimum of one free withdrawal per month, but charges are applicable on all successive withdrawals.

The Perfect Leg-Up

There are three welcome bonuses offered by Bodog, one for each of the main products it has to offer. The sports betting bonus is designed to match 100% of your first deposit, up to $200, with just 3x rollover requirements in place. There’s $600 available for new players at Bodog Casino, which is split into two different bonuses formats for slots and other games. While for those who have a specific interest in poker, Bodog Casino puts a tempting $1,000 bonus up for grabs.
Bodog runs several other promotions too, so there’s plenty of extra value to be found here by regular customers.

Classic Canadian Custom

Awful customer support can surely bring down a gambling site, but thankfully Bodog Casino doesn’t suffer from this. The customer support there is great, and that truly enhances the overall feel of the site. Should you ever stumble upon a problem, or just have an inquiry you want answered, you can be assured of a speedy and useful response. You can get in touch with a member of Bodog Casino staff via e-mail or phone, and there’s an alternative to submit any queries directly from the on-site contact page too.
>> Join Now and Get Free Spins <<

Go Big or Go Home!

Bodog Casino is an excellent place to play casino games; it really is just that obvious. Their online casino is of the highest standard, with a terrific collection of games put on show. The majority of these games can be played through their download software option or the instant play alternative, and they’re also many mobile games available too.
The variety of slots is extremely impressive, with some appealing jackpots on offer. At this point in time there are not any live dealer games at hand, which is probably the biggest disappointment here. There’s unquestionably a lot of fun to be had at Bodog Casino, and there’s a rewarding customer loyalty scheme in place for regular players as well that only heightens the playing experience.

Put on Your Poker Face

It’s without doubt fair to state that poker isn’t the central priority at Bodog Casino. Even though its poker room isn’t quite up there with the very best, it’s still of a decent standard. The focus of such is placed on casual players, given by their use of anonymous tables to circumvent the use of monitoring software that many serious players make use of.
As a consequence there’s very little of high stakes action, and there’s also not much in the way of advanced features either. However, these criticisms are considerably minor, and there’s one huge advantage to playing here. The focus on casual players means the all-round standard of the opponents you’ll find isn’t that great. This provides lots opportunities for making some cash if you are a relatively good player.

Every Dog has its Day

Bodog Casino is generally well liked by the online casino masses and it is fairly easy to see why. They are trusted and they have been around for quite a long time now, with this experience now beginning to shine through in the casino platform they make available. Dare we say, the only real issue we have is that they only accept customers from Canada. Of course, this is great for Canadians, but not so great for people in other parts of the world, as they’re missing out on a truly entertaining online casino experience.
Conclusively, all gambling websites have their shortcomings, and Bodog Casino isn’t exempt from criticism. But the criticism we have however is all relatively minor, and the strengths surpass the shortcomings at Bodog Casino by a country mile. It may have gone under the radar in the past, but it looks like Bodog Casino is now stepping out, with more and more players becoming aware of what this casino has to offer.

*Sept 1, 1998 - Nas on Fat Joe's "John Blaze" said "Like that nigga said in Dead Presidents, "Money to burn"".. https://genius.com/168510 Nas was mentioning the movie line but it's a slight/scorn to Jay because Jay named his single after the movie, which was originally named after the Nas line from "The World is Yours" * Sept 29, 1998 - Jay releases Hard knock life ("hard knock life" - still being disrespectful to the throne - "etched your name out, put jigga on top"..."money cash hoes" - "New York's been soft since Snoop crushed the buildings" also provoked Prodigy because Jay did not stick his neck out to do anything for the East/West beef, and Jay had $hort dog, a west coast artist on his album, so he was super hypocritical for his stance) Jay asks who's the best MC biggie jay-z or nas? on "where i'm from" by inserting himself into the conversation * 1998 - DMX dropped 2 albums in one year as the new rap artist, putting the pressure on Jay and Nas to release the next great commercially successful double disk because DMX at the time could have easily took the reign * Nov 24, 1998 - 2Pac releases greatest hits, 3rd double disk with the official release of "hit em up"

https://en.wikipedia.org/wiki/Jay-Z_albums_discography
If you go through Nas' and Jay's discographies, Jay didn't start pitting himself against Nas until after Jay's summer jam Takeover verse in 2001...6 times
prior to that, there were so many near-misses where their albums would be released within a month of each other, because jay likes to submit last minute songs and verses as responses to what Nas said if Nas released the month prior; otherwise, Jay had to wait a whole year to respond like he did on blueprint 2 after Ether and it was too late or make a single and put it on memphis bleek's album (or like when Jay dissed lil wayne on TI's album on "watch what you say to me"). 2Pac is the king of releasing double discs with 5, which convinced Biggie, Jay, and Nas (as well as others) to release double disks to get that monkey off their back besides going platinum.
Jay went from dissing Nas vaguely to directly to subliminally on full verses to subliminally on lines to subliminally on choruses to subliminally on track titles to subliminally with tactics like rushing Nas on tracks to now pitting his releases against nas...there's a slew of tracks that I probably left out in the back and forth
Ether has an original version described by large professor produced by swizz and another one transcribed on the internet...Nas was working on Ether in the wee hours and steve stout had to step in and fix everything before it was submitted, on Jay-Z's birthday..what a chess move...the original version said jay and dame dash should have been in a plane crash instead of aaliyah and talked about Jay's confrontation with Big Pun because Jay was supposed to perform but took the money as an "appearance fee"
https://genius.com/Nas-ether-unreleased-edition-lyrics
https://genius.com/a/large-professor-says-nas-ether-originally-had-a-reference-to-aaliyah-s-fatal-plane-crash
Nas is a man of science and he plays his foes like chess. he plays aloof in interviews but when asked by The Breakfast Club why Jay seems to align his releases with Nas, Nas gave the politically correct answer that he and Jay move on the same time spectrum and that the question should be redirected towards Jay because he doesn't know why Jay still holds a grudge against Nas and wont let go...maybe it's still because their personalities clash because Jay did everything to get to his position motivated by money and Nas held his ground and would rather have things done his way and involve the audience in critical thinking instead of trying to market them stuff as if they are mindless zombies willing to consume on your every endorsement deal.
Nas and Jay's beef is still brewing on Jay's side while Nas has moved on to other things...jay will forever hold a grudge against Nas for defeating him on Ether by stooping to the level of understanding for Jay's audience to them to also realize that Nas won. Jay can't hold another L to another Ether so he does passive aggressive actions that Nas barely realizes is happening or chooses to shrug it off but jay will be forever trying to feed that insatiable ego of his by pitting himself against Nas in every which way. Nas sees that people like Jay are kings but still hold that begrudging victim's mentality so that is partially why Nas made King's Disease, to cure people of their symptoms and get to the crux of the problem to solve it from within

2020.08.24 08:42 Draemeth [For Hire] Marketing and SEO

2020.08.19 23:22 500scnds [Table] I am Michelle Burrows, civil rights attorney who has spent the last 30 years suing police and prisons for abuse of force and the mistreatment of people. (pt 2 FINAL)

Source
The first half has been tabled here.
Questions Answers
John Oliver in a Last Week Tonight segment stated that it is incredibly difficult to sue police since there needs to essentially be identical case law as precedent. Then he outlined seemingly insignificant details which differentiate the cases (like the abuse happening in a field vs a ravine for example, sorry can't find the exact clip to link). How accurate is he in that regard? I saw this segment. Oliver is talking about a concept called Qualified Immunity. There are several posts here dealing with qualified immunity which is an important issue.
Qualified Immunity is a judge-made law - meaning that it came out of a case many years ago when 1983 cases first began to be popular. The theory in that early case was that cops could not possibly know what actions they took that could be unconstitutional. The concept of suing for your constitutional rights is relatively new. 42 USC 1983 is the vehicle by which people can sue the government for constitutional violations. 42 USC 1983 started in 1871 as the KKK Act. The KKK act was designed to give former slaves legal status as citizens. But no one used this statute as a litigation statute until the 1980s. People just didn't think of it.
For America, suing for your constitutional rights became a sort of "new" concept in the 1980s. Therefore judges felt that police officers were entitled to "fair warning" if their conduct violated "established constitutional rights". The thinking was that similar to a criminal statute you should be advised of the contours of the constitutional requirements. In a criminal case, there has to be a statute defining what the crime is. This serves as "notice" to citizens. That exact same thinking was used to create qualified immunity.
Qualified immunity is basically a used as a barrier to being sued. It's a get out of jail free card. The original statement around qualified immunity was that you needed exact same conduct or situational facts that had been decided by the courts in order to determine future ability to sue. However, in Hope v. Pelzer and Saucier v. Katz the supreme court says that it is enough to provide general information about conduct that may server as the basis for notice of constitutional violations. Thus, shooting someone in the back while they're running away is generally enough to make that kind of shooting a 4th amendment violation.
Recently in Pearson v. Callahan an unfortunate footnote has been elaborated on and expanded beyond its real boundaries such that now cops and police agencies argue that you need exact facts in your case to something similar that's already been litigated. I believe that the supreme court feels that the various federal circuits have lost their fucking mind. Pending right now are a number of cases dealing with qualified immunity from around the country. Hopefully there will be a reset and we can return either to the reasonable findings in Saucier or simply get rid of qualified immunity altogether. Because we don't need it.
Right now defense attorneys file motions for summary judgement on qualified immunity, but you're not entitled to get qualified immunity if there are extensive factual disputes. It's not impossible to get around qualified immunity, but you have to work your ass off to create issues of fact for a jury to decide.
the below is a reply to the above
Maybe I misunderstood, but you as an attorney, need to establish facts to get around qualified immunity and that's a problem? Obviously you have a bias against LE, and from your other responses rightfully so, assuming they're true. However when deciding an officers inevitable future of civil litigation isn't it reasonable to have those suits based on fact? Qualified Immunity only applies when an officer acted within the confines of the law. Once we step out of that boundary we are on our own, as it should be. It's not blanket protection from civil and criminal liability that you seemingly suggest. Also in my experience It's not hard at all to sue an individual officer or department, where it gets challenging is establishing enough facts to get a legal victory. Most of your answers in this AMA are well thought out and impartial, and I agree with a lot of what you have to say. However it also seems irresponsible of an attorney to say "fuck em" when referring to an entire group of people. Edit: Turns out I did misunderstand, and QI is a much bigger iceberg underneath. I appreciate your thoughtful response. And I don't have a bias against law enforcement. They're the first people I call when I'm in trouble. I'm cynical about bad cops. My "fuck 'em" comment is aimed at those who would use their position to intimidate me in order to stop me from doing my job. These officers were in uniform in a marked patrol car and on duty when they did these things. Which is wrong.
Qualified immunity does not apply in the criminal prosecution arena. It is only a defense to being sued for constitutional violations.
You're right, anybody can sue anybody for anything. Winning requires convincing a jury that your story is likely what happened and that someone was hurt. Qualified immunity keeps the jury from even hearing anybody's story. I believe that is wrong.
I have dismissed cases after discovery where I believed that either my client was lying, or the evidence didn't support the lawsuit. Justice should not be a game.
the below is a reply to the above
I think cynicism gets to us all eventually in this field. I hope you believe that me and my colleagues hate bad cops as much as you do. Rooting them out is not very easy from the ground level, civil service law is what hinders us from the inside. As the other attorney pointed out I have some misconceptions about QI and need to do some more reading. I clearly misunderstood you and that's on me. Thank you for your response! Thank you. Dialogue is important and your willingness to engage in this conversation is very meaningful to me.
I've read stories on reddit about activists/whistleblowers/journalists getting harassed by the police after being exposed (i.e. Getting on their "list"). Seems like someone who sues them for a living would get treated pretty poorly. Have you ever experienced retribution from police? I have been stopped randomly by police in small towns and told to watch myself. I had an officer draw a weapon in a deposition. I've been frisk searched for no particular reason (more than once). There is not a name I have not been called. I've had to walk into rooms where departments posted armed officers outside while we were doing depositions.
These are not acts of retribution, but are intimidation and bullying tactics meant to scare and discourage anyone who challenges the police.
This conduct scares a lot of lawyers. It's why many lawyers don't practice this kind of law. For me, it fires me up. Fuck 'em.
the below is a reply to the above
But you also get your attorney fees paid under the 1983 statute, right? 42 USC 1983 is the civil rights act allowing citizens to sue the government for acts committed under color of law in violation of the constitution. 42 USC 1988 is the statute allowing for attorney fees if you win an action under 42 USC 1983.
I once heard a prison nurse joke about breaking an inmate's wrist if he was too handsy and about mid-level providers performing black market cosmetic surgeries in prison clinic. How do you prove actions were committed further than hearsay? Have you heard of prisons holding high value targets without name or trial? Such as Prisoner X I have not heard of black market surgeries in prison clinics. This would cost money - so it would have to be a rich inmate and a competent provider. A unique and very rare combination. However, I have heard of medical experiments done on prisoners.
This is one of the biggest hurdles in this kind of work. I hire investigators and talk to everybody. Most people are stupid and put everything on the internet (Facebook, Twitter, etc.). Those are incredibly valuable exhibits. Ex spouses are also great sources of information. If people get extra money, they'll spend it on toys, so we do financial analysis. Most prisons have electronic tracking of prisoners and staff, so we get those records. Most prisons are video taped in every part of the prison. We send spoilation letters immediately to get those videos, and if the videos are destroyed it can be good for our case. As with police, corrections officials won't snitch on each other. There's really no difference between correction officials and prisoners, they all live by the criminal code. And consequently you can't get prisoners to snitch on a cop either, there's too much retribution involved. In a medical case you have medical records and probably not too much else.
I have not heard of this at the state or county level. Rumor has it that the Feds do it.
I'm considering a career change to pursue civil rights law. Any advice? Here's a few specific questions: * for context, my broadest goal is to affect policy * I'm 40, how long will it realistically take to "become a civil rights lawyer"? * what should I be looking for in a school? * if I should decide this isn't the path for me, what other ways can I get involved? I had this discussion with my wife earlier this week, so I appreciate any and all advice you're willing to share. On Policy Change:
You could work with places like the ACLU, The Innocence Project, or a community based organization for social change. There are a lot of groups that work on voter registration, developing legislative or legal changes with their local governments. Many local governments have civilian police review committees. Anything to get exposed to the work of the government and its interaction with people and how social change is made. Take your pick, there's a huge need to be filled here.
On Becoming a Civil Rights Lawyer & Choosing a School:
1. You need an undergrad degree and law school is three years.
2. Pick a law school that has a litigation clinic where people can come and get law students to help them. This will get you out there learning how to go to court.
3. Take all of the litigation type classes or mock trial activities that you can in law school.
4. If you're in a state that allows law students to practice under the license of an experienced lawyer, do that.
5. Working for the government as a certified law student or beginning lawyer in a government officers, prosecutors office, or a public defenders office will give you a six year head start on your efforts to be a civil rights lawyer.
6. Honestly, I worked for the government for about ten years as a public attorney (county counsel) and I started civil rights work in about 1994 and I think it's just the last four years where I've gotten good at it. You simply have to take case after case, work, work, learn, fight, lose, and win, then get up the next morning and do it all over.
7. There are a lot of education programs sponsored by Bar Association, go to as many as you can on civil rights and civil justice.
8. ACLU has a lot of publications on various issues in civil rights. The National Lawyers Guild has publications. The Department of Justice, Bureau of Justice Assistance has years of research and information. There are organizations that publish on these issues regularly, including the CATO Institute. Get on the internet and start cruising through this stuff.
Is This Your Path?
I firmly believe people should follow their passion. As you know, this is a lot of work. But ultimately if this is what you're meant to do, it will be worth it.
I'm a legal assistant in CA who has volunteered at public interest law firms before, most recently in Veteran's Affairs. Is their a firm or an organization in Southern California working in civil rights litigation and/ or public policy that you can recommend to me as a volunteer? Thank you for volunteering and working in this important area. I would recommend looking into the ACLU, the National Lawyers Guild, Southern Christian Leadership Organization, and the California Civil Rights Coalition. I would also look into the BLM chapter in Southern California.
A friend of mine, Haytham Faraq, works in this area in Southern California and would likely be more than willing to chat with you about other volunteer opportunities.
Good luck! And be safe!
What was the hardest case you’ve ever had to take on? This is a really tough one because each case has its own challenges. The one that really comes to mind on so many level is the Lisa Dunn case.
Lisa was a schizophrenic homeless woman who talked to dead people. She had a long history of mental illness and prior sex abuse. Lisa came in contact with Officer Roger Magana in Eugene, Oregon. Magana was a patrol officer who worked nights so he could more easily access vulnerable women. Like sex workers, homeless women, and drug addicts. Over the course of about five years he reportedly abused and raped approximately 30 women. There had been complaints about Magana from several women but they were ignored by the department because of the social standing of the women.
Magana came across Lisa when she lived with her daughter in a dumpy hotel. Magana threatened to take Lisa's daughter away if Lisa did not perform oral sex. That evolved into Magana threatening Lisa with a gun, compelling her to have sex with him at gunpoint, more than once. This is a pattern that Magana followed with many of the other women.
Lisa made formal written complaints to the city on several occasions about Magana. But they said she was crazy and they couldn't believe her. Lisa persisted. And it was her complaint and one other woman who started the criminal investigation of Magana. Magana was convicted of many of these crimes involving seven of the women including Lisa. He received a sentence of 90 years in prison. The city of Eugene said it was not their responsibility that Magana was raping and abusing women. They said they weren't going to pay for any damages or law suits for the crimes that Magana committed.
In order to secure some type of compensation for Lisa, to get her off the street, and try to get her help, we needed to find a way to sue the "deep" pocket. This meant the city of Eugene. I had to prove that the city of Eugene, through the police department, knew or should have known what Magana was doing and took no steps to stop it.
I took depositions of approximately one third of the entire police force. I accessed all of Magana's dispatch records and calls for service for approximately three years and traced every single call to Lisa's location and determined that Magana had called into dispatch that he was out of service (unavailable) at Lisa's location approximately 53 times.
I also was able to show, from the other victims, a similar pattern. Various officers gave me information of Magana's inappropriate behavior with women in general, but equally important, they told me about the pervasive culture at that department involving inappropriate sexual behavior by officers.
The city of Eugene filed a motion to dismiss this lawsuit against the city itself. They lost. Judge Coffin issued a very scathing opinion. The city of Eugene after three years of extraordinary litigation offered Lisa a seven figure settlement.
This case was hard for me because Lisa was a complicated client, because the city of Eugene refused to take responsibility, and because there was a massive code of silence by other officers that had to be penetrated. The city of Eugene actually took the position that Lisa could not have suffered great harm because she'd been previously raped. So I'm faced with an opponent whose morality I didn't understand.
The law was difficult, the client was difficult, the depositions were difficult, the length of time was difficult, and the evidence was difficult. It's one of those cases that you are tempted to give up on.
How big an impact do you think ending qualified immunity would have on our ability to protect our rights and pursue justice when they are violated? It feels like it would be a massive impact, but I am curious to know the opinion of an expert. This answer picks up where my last qualified immunity answer ended. Qualified immunity has been used to end otherwise valuable and important cases. People don't even get a jury trial on some of these cases, because qualified immunity is decided after depositions but before the trial begins. If the officers lose the motion and a judge says they don't have qualified immunity, they can appeal immediately, normally you have to wait until the end of a case to appeal. This makes cases last 2-4 years longer, cost a lot more money to litigate, witnesses memories fade, people die, and makes justice even more elusive.
Qualified immunity has been used inappropriately to stop the single most important class of law suits in this country: enforcing our civil rights. Without the constitution as a viable and powerful tool there is no hope for justice or equality.
My answer is: This would be huge if qualified immunity were invalidated.
Isn't falsifying records a felony? If a cop lies on a police report, why isn't that cop charged accordingly? There are a couple factors at play here.
The odds that someone knows it's a lie (other than the defendant) is small.
If you think about it, only about five people on the planet will read most police reports. There's the writer of the report, the sergeant of the writer who reviews the report, the DA, the defendant, and the defense attorney. No one believes the defendant or the attorney when they call the officer a liar. But, if in the course of either the criminal case or a civil case you prove that the officer lied that can be the basis for criminal charges. But police are never charged criminally for their conduct.
Which ultimately is a cultural issue. The police departments and prosecutors are so in bed with each other that I almost see prosecutors become cop-groupies. And so the prosecutors tend to defend the police even if it's something that may not be truthful. Or they fail to look at a case fairly and objectively. Thus we have a contagion of bad prosecutions and innocent people being convicted.
The Innocent Project really shows that we have a huge problem with prosecutorial overreach or straight up malicious prosecution.
One last point, if an officer is determined to be one who falsifies reports or testimony good prosecutors will put that cop on what's known as a "Brady List". In criminal cases prosecutors are obligated to provide what's called Brady Material, which is material that tends to show the innocence of the defendant, otherwise known as exculpatory evidence. An officer who is not honest, falsifies evidence, or fails to hand over exculpatory evidence must be disclosed to the defendant. Some prosecutors have what's known as a Brady List that they put police officers on who have a reputation for dishonesty. I had a case where I won a jury trial in a civil matter against an officer who falsified a field test of a drug. It was not a criminal case, it was a civil case, and that jury verdict caused that officer to be placed on the Brady List and he was eventually fired because he could no longer work as an officer. No one would call him to testify, etc.
Is it getting worse, better, or the same? Is it just that more stuff is being documented? And has the rise of cell phones helped win more cases? I think it's the same. It's just better documented.
Cell phones have absolutely changed the landscape and give me hope for change and greater accountability.
I have to assume your disdain for the police is pretty high. What does your realistic vision of policing look like? What checks and balances do you think would make a big difference in avoiding these horrible situations? I am more cynical about police than anything else. I believe that officers who do not comply with the law are a significant danger. I could never be a police officer, I would be too scared.
Here's one of the biggest problems that I've seen. Otherwise good, decent, police officers are often caught in departments that do not have a lot of self examination or really truly work to be better. For example, I sued the city of Eugene a few years ago when one officer raped and abused over 30 women that he met while on duty. No single officer knew everything he was doing, but they knew he was flirty, that he behaved inappropriately with women in the department, that he was a "dog", that he chased skirts all the time, that he ran women's addresses and backgrounds far more than anyone else, and he would disappear off of dispatch sometimes for hours at a time. The good officers refused to see what was in front of them because one of the primary (unspoken) directives of the department was to protect all officers. Even from appropriate scrutiny.
It's a top to bottom culture problem. That's what I see in Minneapolis. Four cops knelt on George Floyd for nearly 9 minutes killing him. I know there were other officers there, and no one stopped them. I suggest to you that good officers are afraid to speak out and stand up for what is right. And therefor they become part of the problem of silence.
Policing is necessary and important. But the culture needs an overhaul.
I think unions help to create this culture and we should revisit the union issue.
I think police agencies have gotten away from truly serving the community because they've gotten away from the community. I think the idea behind community policing is a good idea. The officer is on the street with the people, getting to know the people, understanding what's happening in the community and this makes him more effective and trusted.
I think we need to revisit police officer training and education. It's veered so far into militarization that police officers forget they're part of the community.
I'd like to see more transparency, discipline, and investigation into troubled officers.
Do you feel that there's any hope Qualified Immunity will be taken off the books in the near future? I do. SCOTUS has this issue on its docket this term. I wrote a bit more about qualified immunity in this comment.
How successful have you been over the years at fighting police and prisons for mistreatment? 1. If your metric is money or win/loss record, I get great results for my clients.
2. If your metric is policy, I have won enough issues that judges have written opinions based on my work which have changed the law. These opinions also get cited by lawyers around the country. Which is just the coolest feeling. Kaady v. City of Sandy changed the concept around deadly force to include Tasers in Oregon. Changed the Relation Back Doctrine for federal rule of civil procedure 15 which gives you more leeway to plead against an unknown defendant until you can figure out who they are. Anstett v. State of Oregon changed the standard of care for the treatment of Hep C and other communicable disease in the prison system. I've been very successful on defeating summary judgement on qualified immunity, but I'm not sure I can encapsulate this in one case, it's a compendium of cases over a career.
3. If your metric is justice, I believe that simply fighting and giving the underdog a voice is a win.
Do you ever wish that the money you got from taxpayers to help the taxpayers didn't come from taxpayers and instead came from the pensions of the individual police officer? I get paid out of insurance. Many governments have private insurance policies that will pay on these claims. Other governments are self-insured with a specific designated fund to pay on these claims.
I'm in favor of personal responsibility, but here's the problem: if I want my client to be compensated from the police I'm probably not going to get enough money to take care of the damage done. I have no objections to taking resources from an individual officer, but I don't want the government who employed him to escape responsibility as well.
There's been some ideas floated about officers needing to carry their own "police insurance" - but I'm not sure this would solve any of the intended problems. It might become a benefit that the police unions negotiate under the collective bargaining agreement, so we don't really solve the problem. We're just paying more money for private insurance to cover those individual officers. I'm really only lukewarm on this idea.
Here's one of my personal favorite ideas: a private citizen oversight panel to review use of force, claims, law suits, and all shooting cases. This panel can be comprised of private citizens, police officers with special knowledge of use of force, prosecutors and defense attorneys instead of these cases being reviewed by the internal affairs division of police departments.
Does the Oregon constitution give you different points of law compared to the US constitution? This is a very good question.
You cannot sue for Oregon Constitutional violations. It's stupid, but it's the law. The Oregon Constitution actually goes further in protecting citizens than the federal constitution but unfortunately you really can't bring a separate civil action for those violations until the legislature tells us that we can. We need a state equivalent to 42 USC 1983. That's the homework.
Who can legally, fairly and impartially investigate, indict, arrest and prosecute police? Is this a trick question? Right now, no one. And that's part of the bigger issue. It's usually the prosecutor in the location where the crime occurred. Most prosecutors won't prosecute their own cops unless there is a huge and overwhelming public outcry and it becomes politically expedient for them to do something.
Before the present administration the federal department of justice did a good job of pursuing officers criminally for civil rights violations. That is not happening now.
Is a class action against police unions a thing? Or even possible? A police union, probably not because it does not have direct contact with citizens in order to cause harm. You could ask, what if unions protecting police ultimately causes harm, but the unions are too remote from the acts which cause harm for a lawsuit to likely be successful.
Class action against police agencies for policies, procedures, or conduct which harm people would be an interesting route to go.
Hi Michelle (or son), can you please add the proof to the post as well. I think you probably submitted it when you were added to the calendar. I believe I got it added! Imgur links work?
How often do you receive threats to your safety and/or life that you suspect originate from law enforcement officers, either directly or indirectly? Not anymore. I don't know why.
Most of my cases are very high profile and I think people are afraid that I'll go to the newspaper if they try something shady. Or they know the tactics don't work on me.
I'm also a grandma - who would threaten a grandma?!?
Hello Michelle What would be your George Floyd Top 5? Your top five police reforms you want addressed? 1. Ending police unions.
2. Move away from militarized training.
3. Create multi-disciplinary teams to include specialists in mental illness, domestic violence, racial issues. And let police just be police and not have to deal with every single social issue in the community.
4. Increase funding and support for people who are homeless or mentally ill.
5. Increase discipline and accountability at the top for those who promote, enable, or fail to act on culture issues that lead to the problems we're seeing today.
the below is a reply to the original question
I strongly believe one of the biggest is to disband internal affairs, and create a truely non biased oversite committee. That's absolutely essential for accountability. I don't know where this sits on my top 5, top 10, or top 20 list, but it's definitely needed. Internal affairs and the police review process need reform and greater transparency.
I would like to see an outside panel comprised of police, prosecutors, defense attorneys, and citizens review these cases and reach appropriate conclusions.
Did Jeffrey Epstein kill himself or did the prison guards frame his death to look like a suicide? Has there been other instances similar to this where prisoners mysteriously die and it is ruled a suicide? I have an uninformed opinion... Jeffrey Epstein didn't kill himself.
What would be a reasonable reform of the qualified immunity doctrine? Completely abolish it. It has no place. We've been litigating civil rights cases since the 1980s and if the cops don't know what's unconstitutional by now, they never will. Graham v. Connor has existed since 1989 and it has not been modified, changed, or in any way adjusted. They should just fucking read it and shut up. Why should they get a special defense that no one else gets?
What was the worst case you've seen (it's understandable if you can't go into detail) and what was the good that came out of it (meaning changes to policies/laws and/or the right people going away)? I would say Kaady v. The City of Sandy.
Fouad Kaady was a second generation Lebanese American citizen. Fouad's car caught on fire while he was driving through Sandy, Oregon. As it's burning, he had a couple of near accidents because of his inability to see due to smoke filling the cabin. He runs his car off the road and into a tree.
He gets out of the car, he's got severe third degree burns over the entire front of his body. His clothes were melted off and his skin was peeling off. He starts running, we assume due to shock and pain. Two patrol cars are called to the scene. Fouad is sitting in the middle of the road cross-legged, bent over, and staring at the ground. He's completely naked.
The officers get out of their patrol cars, weapons drawn, and start yelling at him. One officer Tases Fouad in the back. One Taser hook embeds itself into Fouad's back. Fouad jumps up trying to remove the hook from his back and begins to run away from the officers. He is badly injured, and according to the officers "looked like a monster". They did not want to touch him.
Fouad ran on top of a patrol car and was shot 9 times, all but 2 in the back. He was naked when they shot him.
This was the case where we got findings that Tasers are potentially deadly force. The case was very high profile and happened at a time in Oregon when there a couple of other high profile police death cases. It's my opinion that the Kaady case and those other cases began to shift the conversation in Oregon about police death cases. It was a profoundly sad and tragic story. His parents never recovered from the loss of their son.
Do you ever feel like your efforts are futile? I do get discouraged. I do get depressed. But I always ask myself if not me then who will do this? Someone has to fight these battles. I don't think that what I do is futile, but it's always uphill. Sometimes I'd really like to do the downhill trail.
What tends to be a major difference between cases where your client is a POC or not? What are some ways "the system" tries to slow you down? On Having a Client That's a PoC
Cases where my client is a PoC, I have to spend time listening and living my clients life to know what that means as best I can to be able to speak for them at some meaningful level. I am a white woman who has enjoyed many of the great benefits of this country that have been denied to others. I do not know what it means to walk into a grocery store and be followed simply because my skin is a different color. I don't know what it means to walk into a restaurant and not be seated because of the color of my skin.
But I can tell you that the clients I have had who are of a different race than I are afraid to go in front of a white jury. They're afraid to speak in front of a white jury. And they're afraid that a white jury won't treat them fairly.
I don't directly notice it all the time, but my clients have felt a difference in how others in the court system talk to them, treat them, and look at them. But it's not always obvious to me. Which is why I have to listen and pay attention and learn.
In some cases it is more obvious. I've witnessed changes in how opposing counsel speaks to my client. They talk down to, or "dumb things down", which is very obvious to me. My clients tell me that it's normal for them to experience and that it's racially based.
I see this most commonly in white male lawyers. And you can tell when it's happening. They go into this patronizing, physically guarded, off-putting tone as if they don't know how to talk to PoC. It's almost like running into someone in the hallway, and they really want to be somewhere else. That's what it feels like. But I've never experienced racial slurs or other more blatant things in court. The differences are subtle, but constant.
On "The System" Slowing Me Down
I don't think the system itself slows me down. It's usually the defense attorneys, insurance companies, and their lawyers that are trained to drag things out as long as possible. In fact, they're trained to drag things out as long as possible, hoping that your client will give up and go away.
Hi Michelle, thank you for taking the time to do an AMA. How can the average citizen help to make a difference right now? Voting in local elections as well as federal ones, attending protests, signing petitions, contacting your representatives, and donationg to charities that are similarly aligned are things we are told can help make a difference. But is there anything else the general population can do to help with civil rights, ending police brutality, etc? Do anything and everything you can to stir up the conversation and bring awareness to the issues. Black Lives Matter started as a group of regular citizens who rose up with a message and kept at it. All of the things that you list, do them all. Write to your representatives. It may not seem like a big deal, but every voice adds to the volume. Don't give up.
What, if any, circumstances do you think are acceptable reasons to use solitary confinement? How does that contrast with the legally required justifications to use solitary confinement (are there any justifications necessary)? I honestly don't believe solitary confinement is an answer to any problem. I recognize that sometimes folks need to be separated for safety reasons. But every client I've had who has been in solitary (SMU) becomes almost psychotic with worsened behavior for an extended period of time (months or years). It has a huge and immediate impact on social creatures like human beings.
Treatment, counseling, behavior focused work is much better. If the goal is rehabilitation rather than punishment, then solitary confinement has no place in our justice system.
So considering that the bail system inherently punishes poor people for being poor, do you have any ideas on how to remedy this flaw in the system? Edit: Interesting that this is getting downvoted. It seems like there might be some bad faith actors among us shocked Pikachu This is a little outside my area of expertise. Bail is like much of the criminal justice system, arbitrary and controlled too much by the prosecutor. But there has to be some way that lets folks get out of jail while their case is spending, while simultaneously guaranteeing that they'll show up for trial. I don't know what the answer is.
Why are there so few civil rights attorneys the US? Why is it nearly impossible for individuals to find attorneys who are willing to file a subsection 1983? Why don't more attorneys sue judges and courts? I've had to pro se several federal actions over the years because of disinterest among attorneys to attack other attorneys or judges. I'm asked this question a lot. These cases are risky, expensive, and until recently cops have been heroes. A lot of lawyers don't want to represent people who have had involvement with the police because I think privately those lawyers think the client deserved everything they got. A lot of lawyers subscribe to the theory that if you just obey the cops, you'll be alright. And therefor if you get hurt by the cops, you must have done something to deserve it.
You just can't sue judges for work they do on a case. They have judicial immunity.
Hello. What is the single most important lesson you learned in your career? :) Thank you for doing this AMA. Never give up.
Litigation is a roller coaster. You have ups and you have downs. If you quit on the downs you never get to the ups. And you have to never to take no for an answer, never believe the other side at face value, and never ever ever give up. Particularly if you believe in what you're doing.
What do you think about the new "autonomous zone" in Seattle and its new "RappeWarlord" leader? Is this kind of balkanization of urban centers an acceptable price to pay for stopping police violence? I don't know anything about the RappeWarlord leader. This is a great question. I assume you're asking about whether or not creating a police-free zone or a "country within a country" is an acceptable response to the current state of the policing policies.
It is a sad and tragic comment on our society where we are so afraid of the police we have to create safe zones for ourselves. They are likely illegal. I think that civil disobedience is always good on important issues. This is one of the highest forms of civil disobedience I've seen and enormously creative. It's like we're on strike against the police, the people in Seattle are saying "you can't come in here until you get your shit together". I think under the present circumstances is not a bad response to save lives. But, we have to fix the core problems so that we can live as a united community. That is the real goal.
Power to the people!

2020.08.09 18:17 frostedfruitriot The Pit Bull Lobby, 101

This is summarized from National Pit Bull Victim Awareness.org, it is basically paraphased and copied at the end. It is an excellent summary. If anyone wants to do more research on it. Animals 24-7 and Dogsbite.org also have numerous articles on it. Here is one:
https://www.animals24-7.org/2016/08/19/pit-bull-lobby-exposed-in-quebec-as-never-before/
WHO IS PULLING THE STRINGS? -The US pet industry is worth 16 billion dollars. Pit bulls create work for vets, work for shelters, breeders, and even for illegal dog fighters...this is about money for people that can't or won't work in a less bloody, more sustainable fashion. If a person promotes pit bulls, remember this, they are often getting money, or at least some kind of ego boost from their dangerous dogs. The more staunch they are, the more likely they are to be breeders of pit bulls, or making their money off of them.
Level one: Financing source ANIMAL FARM FOUNDATION Run by an American millionaire, Animal Farm Foundation has for its motto: “Equality for pit bulls.” The pressure group devotes itself entirely to combatting against any regulation targeting its dogs. After inheriting a fortune from her father, Jane Berkey, who also owns a literary agency, turned over at least $6 million to her group, $2.85 million in 2013, according to government records. She pays 9 employees (one of whom, the director, makes more than $100,000 a year) and finances numerous groups that share her philosophy.
Level two: The researchers NATIONAL CANINE RESEARCH COUNCIL (NCRC) To produce studies, AFF bought a private research body in 2007. The acquisition was kept secret until the victims’ group Dogsbite discovered this during litigation. The National Canine Research Council (NCRC) was created by a veterinary technician, Karen Delise. Neither an academic researcher nor a veterinarian, she self proclaims as the “greatest national expert on deaths caused by dog bites.” An “action fund” permits the organization to engage in lobbying, according to a government registration. The NCRC is linked to several advisors and consultants. This is the case for Gary Patronek, the veterinarian who co-signs (NCRC) studies, and in the case of the Page ~ 16 former chief animal control officer of Calgary, Bill Bruce, who was still employed in that civil service job at the time he accepted his association with NCRC. The agency already had consultant Glen Bui on board, whose heavy criminal record can be found online (illegal weapon possession, obstruction of justice, domestic violence and harassment). Still, thanks to millions from Animal Farm, the NCRC finances like-minded researchers—notably on the issue of identification of pit bulls, information available on their website.
Level 3: Publication JOURNAL OF THE AMERICAN VETERINARY MEDICAL ASSOCIATION (JAVMA) The American Veterinary Medical Association publishes NCRC studies in its journal. On its own website it proposes sample letters [for readers to write] contesting any law aimed at pit bulls. Moreover, its site has a link to AFF. The Association added the following introduction to a famous 2000 study: “In contrast to what has been reported in the news media, the data contained within this report CANNOT be used to infer any breed-specific risk for dog bite fatalities. [To reach that conclusion] it would be necessary to know the numbers of each breed currently residing in the United States. Such information is not available.” Even if they are opposed to a breed ban, for practical reasons amongst others, the authors of the study—seasoned in the ministry for Health and government institutions—nevertheless concluded: “In spite of potential bias and the lack of data on the canine population, pit bulls seem to be implicated in 42% of fatal tragedies. We do not believe that in the United States, the proportion of pit bulls amongst the dog population even comes near to approaching 42%. We therefore believe that the disproportion of deaths associated with pit bulls is real and escalating.”
Level 4: The political lobby BEST FRIENDS ANIMAL SOCIETY The studies of the AFF network allow [lobby] groups to put pressure on politicians. They propose regulations [they favor] and try to overturn those they dislike. Sometimes with success. The central facts about Best Friends Animal Society are that it manages $60 million and has for its motto: “Save them all,” for it is opposed to all euthanizing of animals. Its senior advocate, Ledy VanKavage sits on the board of AFF. The website of Best Friends Animal Society indicates that she paid an ex-economist from the tobacco Page ~ 17 industry, John Dunham, to create a fiscal calculation scheme designed to advise governments on the cost of breed banning. [Dunham’s] calculations were attacked in the Texas Tribune in 2011. The following year, before a referendum on pit bulls in Miami-Dade, a government committee discovered that the real costs incurred in targeting dogs was 65 times lower than those claimed by Dunham. “With all its money, the lobby [can afford to] finance lawyers and harass elected officials. And if it doesn’t get what it wants, it threatens to finance the campaign of their political opponents!” denounces Angela Provo, whose son Beau Rutledge was killed by a family pit bull.
Level 5: The distributors THE ANIMAL CARE INDUSTRY All the lobby studies are abundantly distributed by animal-based companies like shelters, breeders, trainers, etc. In Montreal, they are [distributed] by, amongst others, the SPCA, whose mission is to avoid euthanizing dogs and whose two most senior executives are themselves owners of pit bulls. On social media, pit bull owners deploy these studies relentlessly and accuse all their opponents of ignorance. Certain more aggressive ones have even threatened the mayor of Quebec City with death. Unfortunately, some militant activists have come to a tragic end, killed by their own fighting dogs—notably Darla Napora, at the time 8 months pregnant (California, 2011) and Rebecca Carey (Georgia, 2012)

2020.08.08 23:32 Draemeth [For Hire] Marketing and SEO, 30 hourly

PM for examples of work relevant to your business
